What exactly is insanity in law?

I have absolutely no idea. Insanity seems to vary from the psychological aspect when used in court. Can anyone clarify for me?

Thats bullshit, they should die. If they are supposedly insane then they will kill again or kill themselves, they ARE insane for a reason.

There is 'temporary insanity'. It makes whatever sentence a lot less harsh from being unable to control you actions, just as cold-blooded murder is dealt with a lot more harshly than hot-blooded murder.

Executing someone for something they have no control over is a pretty unfair decision.

By law, I believe insanity is described as the inability to tell from right or wrong. Mental retardation really isn't insanity, so yes, while it's possible that a mentally retarded person could not tell the difference between right and wrong, they probably wouldn't be declared "insane." Usually when someone actually gets away with the insanity defense, it's because they're so psychotic they have no semblance of a sound mind.

On a side note, it's illegal to execute a mentally retarded person for their crimes.
